    SECTION 1 — AGREEMENT TO TERMS

    By purchasing services from Highly Favored Digital LLC ("HFD," "we," "us"), you agree to these Terms. These Terms govern all service agreements, subscriptions, and transactions between you and HFD.

    SECTION 2 — SERVICES

    HFD provides digital marketing, website builds, CRM automation, AI receptionist setup, payment processing integration, social media management, and related technology services. Service scope is defined at the time of purchase. HFD does not guarantee specific business outcomes, search rankings, lead volumes, or revenue results. All examples and case studies are illustrative only.

    SECTION 3 — FEES, BILLING & SETUP

    Monthly subscriptions are billed in advance. Subscriptions auto-renew each billing cycle unless canceled.

    Setup fees are collected at the time of signing and are NON-REFUNDABLE once any work has begun. Work is considered begun upon intake questionnaire completion, strategy call, asset collection, or any build activity by HFD — whichever occurs first.

    Monthly fees are NON-REFUNDABLE and NON-PRORATED. If a client cancels mid-month, no partial refund is issued for the remaining days in that billing period.

    Failed payments may result in service suspension. Clients are responsible for maintaining accurate payment information on file.

    SECTION 4 — CANCELLATION

    Clients may cancel at any time with no minimum commitment period required. Cancellation takes effect at the end of the current billing cycle. To cancel, contact HFD at matthew@highlyfavoreddigital.us or 706-715-8979.

    SECTION 5 — OWNERSHIP OF ASSETS

    Clients retain full ownership of all assets associated with their account, including but not limited to: their domain name, website content, contact lists, CRM data, photos, logos, and any other materials they provided to HFD.

    Upon cancellation, clients are welcome to request a copy of their website content and contact data. Website builds are constructed inside HFD's platform infrastructure and are not directly transferable as a live site; however, HFD will provide a content export upon request at no additional charge.

    HFD retains no ownership over client-provided content or customer data.

    SECTION 6 — AI & AUTOMATION

    HFD uses AI tools, automation workflows, and SMS/email systems to deliver services. AI-generated content may require client review before use. Clients consent to automated calling, texting, and follow-up sequences as part of the HFD Hub Engine system.

    SECTION 7 — A2P 10DLC MESSAGING

    Where SMS services are included, both HFD and the client must comply with A2P 10DLC carrier requirements. Clients are responsible for maintaining valid opt-in consent for their contact lists. Carrier fees or pass-through charges related to 10DLC registration may apply.

    SECTION 8 — LIMITATION OF LIABILITY

    To the maximum extent permitted by law, HFD's total liability for any claim arising from services shall not exceed the amount paid by the client in the three (3) months preceding the claim. HFD is not liable for indirect, incidental, consequential, or punitive damages of any kind.

    SECTION 9 — NO GUARANTEES

    HFD makes no guarantees regarding results, ROI, search rankings, lead generation, or revenue. All projections and estimates are forward-looking and based on assumptions that may not materialize.

    SECTION 10 — GOVERNING LAW

    These Terms are governed by the laws of the State of Georgia, United States. Any disputes shall be resolved in a state or federal court located in Georgia.
